ZEST IS THE OFFICIAL RETAIL INCENTIVE PROGRAM FOR DKSH LL NA. THIS PROGRAM CAN BE REVOKED AT ANY TIME WITHOUT PRIOR NOTICE. ZEST IS AN AT WILL PROGRAM THAT DOES NOT CONSTITUTE ANY CLAIMS FOR PAST, PRESENT OR FUTURE COMPENSATION OF ANY KIND. ISSUING INCENTIVES UNDER THE RULES OF ZEST IS IN THE SOLE DISCRETION OF DKSH LL NA.
ELIGIBILITY: ZEST is open only to legal residents of the fifty (50) United States and the District of Columbia over the age of eighteen (18). ZEST is open only to those sales representatives and employees of authorized retail partners that have received a written notice about their eligibility. ZEST is not available to corporate entities or to retailer stores but only to the individual sales representatives of the DKSH LL NA authorized retail partner. In order to receive ZEST, eligible sales representatives must complete the ZEST submission form on the DKSH LL NA website WITHIN TWO WEEKS of the sale that the incentive is claimed for. Later submissions will not be considered. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Participation in ZEST constitutes a full and unconditional acceptance of these Official Rules.
ZEST PERIOD: ZEST have no specific timeframe or period. Sales representatives and employees of authorized retail partners that are eligible for ZEST (the "Zest participants") will be notified about possible restrictions or periods. Eligibility can be revoked at any time at the sole discretion of DKSH LL NA without prior notice.
ZEST ENTRY INSTRUCTIONS: Entrants may submit an entry form online at shop.mauricelacroix.us/zest within TWO WEEKS from the sale of the watch that the incentive is claimed for. Limit One (1) Online Entry per sale. The submission of the entry form is sufficient as temporary proof of sale. At its discretion, DKSH LL NA may verify the correctness and/or completeness of the entry with further documentation (e.g. original sales receipt). By submitting your entry for ZEST you expressly agree to produce such documentation if requested without alteration or omission. Sales that have been submitted with incorrect Zest entry information, including but not limited to, an incorrect actual net sales price for the sale, are not eligible for Zest rewards. A later submission of correct information for the same sale does not heal this ineligibility. DKSH LL NA may, at its sole discretion, disqualify Zest participants who submitted incorrect Zest information from any and all future Zest rewards.
ALTERNATE MEANS OF ENTRY: Entrants may also enter ZEST by printing out the online form and sending it to DKSH LL NA by regular mail or by fax to (609) 964-1838.
ZEST REWARDS: Eligible participants who complete the ZEST form will receive ZEST REWARDS (corporate checks or similar cash payments) valued according to the sale submitted. ZEST REWARDS will not be replaced if lost or stolen and are not transferable. ZEST REWARDS are redeemable for cash. All expenses not specifically mentioned herein are not included as part of any ZEST REWARD and are solely the participant's responsibility. DKSH LL NA may, in its sole discretion alter the ZEST REWARDS awarded or replace them with ZEST incentives of similar or different value.
GENERAL RULES: By entering or participating in ZEST, participants agree to be bound by these Official Rules, and by the decisions of DKSH LL NA, which are final and binding in all respects. DKSH LL NA is not responsible for: (1) any incorrect or inaccurate information submitted by any entrants or technical failures of any kind, (2) unauthorized human intervention in any part of the entry process or the ZEST, or (3) any other computer, technical, human or other error, problem or malfunction that may occur in connection with the administration of the ZEST, the processing of the entries, or the selection or notification of participants. DKSH LL NA reserves the right, at its sole discretion, to cancel, terminate, modify or suspend ZEST (or portion thereof) at any time without notice. DKSH LL NA also reserves the right at its sole discretion to disqualify the entry of any participant for any reason or no reason.DKSH LL NA is not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of ZEST CARDS or any other ZEST incentive issued.
PARTICIPANT OBLIGATIONS: By participating in the ZEST, you agree to be bound by these Official Rules and the decisions of DKSH LL NA. By accepting ZEST incentives participant agrees to release and hold DKSH LL NA harmless from and against any and all losses, damages, rights, claims, actions and liabilities of any kind in connection with ZEST or receipt or redemption of ZEST incentives. The participant assumes all liability for any injury, or damage caused, or allegedly caused by, participating in ZEST or use or redemption of ZEST incentives. Any disputes that may arise hereunder shall be governed in all respects by the laws of the state of New Jersey without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be held in the state and federal courts of the state of New Jersey.
